Privacy Policy
1. Introduction
This Privacy Policy ("Policy") describes how 1881 HM Partners, LLC, doing business as Collier Hall Suites ("Collier Hall", "we", "us", or "our"), collects, uses, discloses, and protects information about you when you (a) visit or use our website, mobile application, or member portal; (b) access or use the Permitted Areas (as defined in our Terms and Conditions / Membership Agreement) of the building located at 1881 Howell Mill Road, Atlanta, GA 30318; (c) become a member, licensee, guest, or applicant; or (d) otherwise interact with us (collectively, the "Services"). This Policy is incorporated by reference into our Terms and Conditions / Membership Agreement. By accessing or using the Services, you agree to this Policy. If you do not agree, do not use the Services.
2. Children
The Services are not intended for, or directed to, individuals under the age of eighteen (18). We do not knowingly collect personal information from anyone under 18. If you become aware that a child under 18 has provided us with personal information, please contact us at jason.pyron@streamrealty.com and we will take reasonable steps to delete it.
3. Information We Collect
3.1 Information You Provide. We collect information you provide directly, including: name, postal address, email address, phone number, date of birth, photograph or profile image, emergency contact information, username and password, payment card or bank account information, billing address, employer or business name, vehicle license plate number and related vehicle information (for parking purposes), and any other information you submit through forms, account registration, questionnaires, surveys, or correspondence with us.
3.2 Information Collected Automatically. When you use the Services, we may automatically collect: device information (IP address, browser type, operating system, device identifiers), usage information (pages viewed, features used, time spent, clickstream), location information (approximate location based on IP, and—if you grant permission—precise location from a mobile device), check-in and access logs (date, time, and entry point of each visit to the Permitted Areas), and Wi-Fi network usage data.
3.3 Audio and Video Surveillance. The Building and the Permitted Areas are monitored by closed-circuit television (CCTV), and certain non-private common areas may include audio recording. We use this information for security, member identification, rules enforcement, incident investigation, and operational purposes. Footage and recordings are typically retained for up to ninety (90) days, except where retained longer for an active investigation, legal claim, or as required by law.
3.4 Cookies and Tracking Technologies. We and our service providers use cookies, pixels, web beacons, local storage, and similar technologies to operate the Services, remember preferences, analyze usage, and support marketing. You may control cookies through your browser settings; disabling cookies may affect functionality.
3.5 Information from Third Parties. We may receive information from payment processors, identity verification services, marketing partners, social media platforms (if you connect an account), publicly available sources, and your employer (if your membership is sponsored by an employer).
4. How We Use Information
We use the information we collect to: • provide, operate, and maintain the Permitted Areas and Services; • process membership applications, payments, renewals, and refunds; • verify identity and authenticate access; • manage parking access and enforce parking rules, including matching license-plate information to authorized Members; • communicate with you regarding your account, transactions, and customer service requests; • send service announcements, updates, and policy changes (including changes to hours of access); • send marketing and promotional communications (subject to your opt-out rights); • personalize your experience and develop new features; • monitor, secure, and improve the Permitted Areas and Services, including investigating incidents and rules violations; • detect, prevent, and respond to fraud, abuse, security incidents, and unlawful activity; • comply with legal obligations and enforce our Terms and other agreements; and • establish, exercise, or defend legal claims.
5. How We Share Information
We may share information in the following circumstances:
Service providers: with vendors who support our operations, such as payment processors (e.g., Stripe), hosting providers, access-control and CCTV vendors, email and communications platforms, analytics providers, and professional advisors. These vendors are bound by contractual confidentiality and use restrictions.
Affiliates: with our parents, subsidiaries, and affiliated entities for purposes consistent with this Policy.
Building owner / property manager: with the owner and property manager of the Building, and other tenants where reasonably necessary, in connection with security incidents, building operations, and rules enforcement.
Employer-sponsored memberships: if your membership is paid for or arranged by your employer, we may share information about your enrollment, attendance, and use with your employer.
Business transfers: in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets.
Legal and safety: to comply with applicable law, subpoena, court order, or other legal process; to enforce our Terms; to protect the rights, property, or safety of Collier Hall, our members, the Building, or the public; and to cooperate with law enforcement.
With your consent: for any other purpose disclosed at the time of collection or with your consent.
Aggregated or de-identified data: we may share aggregated or de-identified data that cannot reasonably be used to identify you.
We do not sell your personal information for monetary consideration. Some sharing for advertising or analytics may be considered a "sale" or "sharing" under certain state laws; see Section 8.4 for your rights.
6. Data Retention
We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Typical retention periods include: account information for the duration of your membership plus seven (7) years; transaction records for seven (7) years; CCTV and audio recordings up to ninety (90) days; vehicle license plate data for the duration of your membership plus ninety (90) days; marketing data until you opt out; and access logs for up to three (3) years.
7. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (TLS/SSL) for sensitive data, access controls, and PCI-DSS-compliant payment processors. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding your account credentials and for any activity under your account.
8. Your Rights and Choices
8.1 Account. You may access and update your account information through the member portal or by contacting jason.pyron@streamrealty.com.
8.2 Marketing Opt-Out. You may opt out of marketing emails by clicking "unsubscribe" in any marketing email or by contacting jason.pyron@streamrealty.com. We will continue to send transactional and account-related communications.
8.3 Cookies. You may control cookies through your browser settings.
8.4 State-Specific Rights. Depending on your state of residence, you may have additional rights under applicable state privacy law (including, where applicable, California's CCPA/CPRA; Virginia's VCDPA; Colorado's CPA; Connecticut's CTDPA; Utah's UCPA; Texas's TDPSA; and similar laws). These rights may include: the right to know or access the personal information we hold about you; the right to request correction of inaccurate information; the right to request deletion of your personal information; the right to opt out of "sale" or "sharing" of personal information for cross-context behavioral advertising; the right to limit the use of sensitive personal information; and the right to non-discrimination for exercising these rights. You may designate an authorized agent to submit a request on your behalf, subject to our verification process. We will respond within the timeframe required by applicable law.
8.5 Do Not Track / Global Privacy Control. Our website does not currently respond to "Do Not Track" signals. Where required by law, we honor recognized opt-out preference signals such as the Global Privacy Control (GPC).
9. Third-Party Links and Services
Our Services may contain links to or integrations with third-party websites and services. This Policy does not apply to those third parties. We encourage you to review their privacy policies before providing them with your information.
10. International Users
The Services are operated in the United States. If you access the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.
11. Changes to This Policy
We may update this Policy from time to time. The "Effective Date" at the top reflects the most recent update. Material changes will be communicated via email or through the member portal and will take effect on the date stated in such notice or, if no date is stated, thirty (30) days after notice. Continued use of the Services on or after the updated Effective Date constitutes acceptance of the updated Policy.
